Userlytics’ Privacy Policy:
Use of “AI UX ANALYSIS” and other Artificial Intelligence Tools
Last Updated: October 2024
This Artificial Intelligence Privacy Policy outlines the practices of Userlytics Corporation (“we,” “us,” or “our”) regarding the use of our integration with OpenAI (ChatGPT) and associated APIs and features, (“AI UX Analysis”), in relation to the collection, processing, and protection of personal data. By using our services, you consent to the terms described in this policy.
1. Opt-in Feature
The use of AI UX Analysis is a default feature, which means AI UX Analysis is automatically integrated into all supported studies and projects. If a Client wishes to opt-out of the AI UX Analysis feature, Client may opt-out upon notifying a Userlytics representative in writing that Client does not desire the AI UX Analysis be included in their service offerings.
While some AI technology within our services is subject to configurability and can be disabled upon client request, this may not universally apply to all AI systems employed in our services. For instance, our audio transcription services are facilitated through a partnership with Amazon, utilizing systems that some might categorize as AI technology. The configuration and disabling options may differ based on the nature of these systems and the terms outlined in our partnership agreements. Users should be mindful of the specific functionalities and limitations inherent in each AI system deployed in our services.
2. Use of AI Tools
We use AI UX Analysis to perform data analysis, as long as the Client has opted in for its usage, as well as upon Client’s additional opt-in on a study-by-study basis. Userlytics’ AI UX Analysis tool provides key points and actionable insights from the client’s qualitative user experience video based studies. In such cases, following the completion of a study and upon request by Client in the specific study, we upload encrypted transcriptions to OpenAI (ChatGPT) to provide a synthesis and analysis of the results. The AI UX Analysis feature should only be used as a supplement and not as the sole source of evaluation; AI UX Analysis insights may not capture all the necessary metrics required for valuable insights. Therefore, it is recommended that the results of the AI UX Analysis be used in conjunction with other evaluation methods to ensure a comprehensive assessment of the user experience.
3. Data Collection and Processing
The data collected and processed by AI UX Analysis consists of data extracted from a specific study. The specific data collected depends on the structure of the study, which is solely determined by the client.
4. Data Security and Confidentiality
We maintain industry-standard security protocols to ensure the security and confidentiality of the data collected by AI UX Analysis. Our security practices are governed by applicable data privacy laws, and we obtain annual certifications, such as ISO 27001, to demonstrate our commitment to robust security measures. For detailed information regarding our security policies, please refer to our Information Security Policy [https://www.userlytics.com/information-security-policy/].
5. Data Sharing
We do not share the data analysis results obtained from AI UX Analysis with any third parties, except for our Clients who have engaged and paid for our services. Furthermore, we have disabled the use of data by OpenAI (ChatGPT), for their own language model training, so that the information uploaded is not used for any other purpose.
6. Data Retention
The data uploaded to the system is purged directly after the completion of the analysis. We do not retain any data within OpenAI (ChatGPT) beyond the analysis process.
7. Automated Decision-making
We do not engage in any automated decision-making processes based on the data collected by AI UX Analysis. The analysis performed by AI UX Analysis serves as a tool for review and should not be considered the sole determiner when evaluating results. We recommend using our UX Consulting service, in conjunction with AI UX Analysis to create the most complete analysis.
8. User Rights
We have signed a Data Processing Agreement (DPA) with OpenAI, which guarantees the rights granted under applicable data protection laws.
For detailed information about your rights as a tester, please refer to our Privacy Policy for Testers [https://www.userlytics.com/privacy-policy-testers/].
For clients, please consult our Privacy Policy for Clients [https://www.userlytics.com/privacy-policy-clients/].
9. Cookies and Tracking Technologies
In addition to our use of AI UX Analysis, we may utilize cookies or similar tracking technologies. For more information on how we use cookies, please refer to our Cookie Policy [https://www.userlytics.com/cookie-policy/].
10. Minors
If applicable, we adhere to age restrictions and special provisions regarding the collection and processing of data from minors, as specified under applicable data protection laws, such as the General Data Protection Regulation (GDPR).
11. Privacy Policy Updates
We are aware of the ongoing changes to legislation and the evolving landscape of AI use. We are committed to staying up-to-date with these developments and constantly evaluating our practices to ensure compliance and alignment with best practices. As the regulatory and technological landscape evolves, we will review and update our privacy policies and our use of AI tools accordingly. We encourage you to check our website periodically for any updates.
